Qua’an –Pan Sacked LGA Chairman, Kwalu Sues Plateau Govt, Others To Court

A Plateau State High Court 10, presided over by Justice Nafisatu Mohammed on Friday has adjourned to 1st September 2020 for hearing on a suit involving the sacked Chairman of Qua’an-Pan Local Government Counsel,Hon Isaac Kwalu (plaintiff)  originating surmount.

 

 

The plaintiff counsel, Solomon Umoh says that his client was impeached by 16 members of the Local Government Parliament on the 5th August 2020, even when there is an existing motion exparte issued on the 4th August 2020 and the house of Assembly suspended him on the 30th June 2020.

 

The plaintiff counsel, Barr Yetunde Nze (Mrs) and N.M. Nyelong taken brief of Barr Solomon Umoh ,SAN ,told the court that their motion on notice /motion of exparte was served on the 1st,2nd, and 3rd defendants but efforts to effect service on the Speaker Rt Hon Ayuba Abok prove abortive as the Plateau State House of Assembly were sealed up for fumigation exercise.

 

She explained that the bailiff went down to Qua’an-Pan Local Government Council for service only to discover that security personnel had already besieged the council secretariat and no staff was on the ground.

 

Yetunde Nze added that their client, Hon Isaac Kwalu who was at the Local Government and Chieftaincy affairs headquarters in Jos waiting for the panel of investigators conference hall only to get the news that his Deputy has already been sworn-in by the Executive Governor Simon Bako Lalong.

 

The Lawyer, Mrs Nze said, Inline, with the practice, we are applying for a short adjournment to file another fresh application to reflect the present state of affairs so in these circumstances we are urging the court to grant us a very short notice to enable us to serve counsels.

 

She,however, said services effect were served on 26th July 2020 on the 1st defendant,2nd defendant on 4th August 2020, and 3rd defendant on 11th August 2020 which the defendants’ counsel confirmed it to the court.

 

They alleged that the dismissed chairman of Qua’an-Pan Local Government,Hon Isaac Kwalu has refused to allow the state government to be temper with the council funds and allegations of indicating interest to vie for Plateau Southern senatorial seat was amongst issue prompted his removal.

 

 

The counsel to the defendants, Barr J.I.Mwantu did not oppose the plaintiff counsel application for adjournment.
