Publisher Of Impression Magazine Obtains N8.6 Million Judgment In Plateau

A Plateau State High Court sitting in Jos, the Plateau State capital on Wednesday has entered judgement of over 8,600,000 .00 Million naira in favour of  the publisher of Funom communication  in a suit No PLD/J624M/2019 .

 

Justice Christine I. Dabup in her judgement order, Riyom, Langtang South and Wase Local Government Areas , LGA , of Plateau State to comply with the condition given them owning the defendants failures to file for their claim.

 

 

The publisher of Funom communication Nigeria limited, Modecai Ibrahim, in his writing of summons says, you are recommended that within eight (8) days after the service of this writing on you inclusive of the day of such service, You do cause an appearance to be entered for you in an action at the  suit of Funom communication Ltd and take notice that in default of your so doing the plaintiffs may proceed therein and judgment may be given in your absence.

 

The judgment reads, “this served within twelve calendar months from the date thereof, or if renewed within six calendar months from the date of the last renewal including the day of such date and not afterwards.”

 

The plaintiffs claim against the defendants jointly and severally as follow:

 

(a)  The Sumsof N 364,300.00 from 1st and 3rd defendants and N164,300.00 from 2nd defendant as the outstanding balance out of N564,300.00 being the original principal cost of advertisement placed in the plaintiffs in July /August, 2028  Edition of the New Impression magazine.

 

 

(b)  The sum of N2,031,480.00 from each of the defendants representating 30per cent monthly credit facility penalty of the unpaid original cost of advertisement sum per month from 17th August, 2018 4th till 17th July, 2019 till judgement is delivered respectively.

 

(c)  30 per cent monthly credit facility penalty on the unpaid original principal cost of advertisement sum of N564,300.00 from 17th October, 2019 till judgement is delivered.

 

Counsel to the plaintiff, Barr. A. I. Madaki said the judgement involved three Local governments which had a contractual agreement on behalf of their LGAs which the bridge the contract agreement entered.

 

 

However, the counsel explained that the plaintiff approached the court seeking for peaceful settlements which wasn’t reach but he decided to go on litigation.

 

 

Madaki said that after today judgement his client is now waiting for compliance from affected council chairmen of Riyom, Langtang South and Wase LGAs.
