PDP Case Against PLASIEC: Court Adjourns To 20th August For  Ruling On Jurisdiction, Consolidation

A  State High Court  in Plateau Division  has adjourned the case of People Democratic party, PDP challenging their exclusion from participation on October, 2021 to 20th of August  for ruling on consolidated hearing , and jurisdiction  submitted by claimant /respondent counsel ,Barr Edward  Pwajok ,,SAN  ,

He said that the court hear on both side of the PLASIEC and PDP when Counsel to PLASIEC ,Barr Garba Pwul applied that the matter shouldn’t be entertain by a vacation judge .

Pwajok said they opposed that based on section 43 order of the plateau state high court rule the court can use his position to entertain even though is a matter for regular court .

According to him, all we asking the court now is to give us direction either the court agreed that this matter to taken or the matter be  deny until  after the vacation ,we asking the court to nullify or rule out Oct dateline for the conduct of election.

However, counsel to PLASIEC ,Garba Pwul ,SAN, argued that to allow them for consolidation is a total violation of the principle of fear hearing calling for consolidating all the processes ,we are entitled to adequate notice to consolidate .

He urged the court to give them adequate time because the exercise was in violation of order 43 sworn-in affidavit.

Pwul told the court that the fresh motion introduced is causing panic but that can’t affect the proceedings of the day as they are ready for business of the day  .

Pwajok confirmed that the adjournment was in pursuance to motion on notice filed by the respondent counsel seeking the order of the court stop the proceedings of hearing but we objected to the line of argument .
