PDP Alleges Fraud In Qua’an Pan South State House Of Assembly Election

The Peoples Democratic Party, PDP, in Plateau has told the Plateau State Election Tribunal sitting in Jos the Plateau state capital in the case between Hon Abubakar Mohammed against Dogo Zainab that there were irregularities, alterations, over voting and noncompliance to the electoral act where results were doctored in favour of the APC candidate who scored, 17,738, while Zainab Dogo got 14,944.

 

The basis on the above results the 1St Respondent declared the 2nd Respondent as the winner of the said election and equally returned him elected. INEC FORMS EC8C(I) AND EC8E(I) respectively for Qua’an Pan South State Constituency of Plateau State are hereby pleaded.

 

Hajiya Zainab Dogo in her petition disclosed that Election into the membership of the House of Assembly for the Qua’an Pan South State Constituency, Plateau State held on the 9th March, 2019 was marred with irregularities alterations and non-compliance to the electoral act.

 

The petitioners averred that the said election conducted into the membership of the House of Assembly for the Qua’an Pan South State Constituency, Plateau State held on the 9th March, 2019, did not comply with the Electoral Act, 2010 (as Amended) and/or that the said election was ridden with wide spread cases of over voting.

 

The Petitioners aver that there was over voting in Ungwan . Wakili II with code 020 in Kurgwi RA wherein the total votes cast exceeded the number of accredited voters. 1. election into the membership for the House of Assembly for the Qua’an Pan South State Constituency, Plateau State in the election held on the 9”“ March, 2019.

 

She complaint that the 3rd Respondent is a registered political party in Nigeria,adding the 2&1 Respondents at the said election held on the 9th March, 2019, nominated and sponsored the 2&3 Respondent as its candidate.

 

The 2nd Respondent contested and participated in the election into the membership of the House of Assembly for the Qua’an Pan South State Constituency, Plateau State.

 

The 1St Respondent also announced the results of the said election, declaring the 2nd Respondent as winner of the election and returned him elected on Sunday the 10m March, 2019.

 

The Petitioners hereby plead all the INEC Forms ECBC (I) and EC8E(I) as well as their duplicate copies and shall rely on same during the hearing of the

 

. PETITIONERS’ RIGHT TO PRESENT THE ELECTION PETITION …..

 

The 1St Petitioner was the candidate of the 2nd Petitioner for the election into the membership of the House of Assembly for the Qua’an Pan South State Constituency, Plateau State on the 9th March, 2019.

 

The 1St Petitioner has the right to present this petition on the ground that she had the right to be returned or declared duly elected having scored the majority of lawful votes cast at the said election.

 

The 2nd Petitioner equally states that having sponsored the 1St Petitioner is entitled to have its candidate duly returned as the elected member of the House of Assembly for the Qua’an Pan South State Constituency, Plateau State on the basis of scoring the majority of lawful votes cast at the said election.

 

The declaration of the 2&1 Respondents candidate of the 3rd Respondent on the 10/3/19, as the winner of the election which was conducted by the 3rd Respondent on the 9/3/2019 has aggrieved the Petitioners.

 

The Petitioners aver that, being aggrieved by the conduct of the 15t Respondent, they have the right to present this election petition.

 

HOLDIN OF THE ELECTION AND THE RESULT Your Petitioners state that at the election into the membership of the House of Assembly for the Qua’an Pan South State Constituency,

 

  1. Langkaku 032; in Namu RA 11. Your petitioners plead INEC FORMS EC8A (I) of the above affected areas respectively.

 

Your petitioners also aver that the election conducted by the 15’t Respondent into the membership of the House of Assembly for the Qua’an Pan South State Constituency, Plateau State held on the 9th March, 2019, did not comply with the Electoral Act, 2010 (as Amended) in that at the said election were made ballots were used in excess of votes cast as well as no entries for spoilt ballots thus:

 

  1. Kwari II, 022 where 53 ballots were unaccounted for in Namu RA

 

  1. Ung. Yashi Namu I, 001 where 4 ballots were unaccounted for under Namu RA 11;

 

iii. Ung. Yashi Namu II, 002 where 8 ballots were unaccounted for under Namu RA 11;

 

  1. Dam Road (Kofar Danbaba) 005, where 23 ballots were unaccounted for under Namu RA 11;

 

  1. Kofar Ubandoma 009, where 40 ballots were unaccounted for under Namu RA 11;

 

  1. Tshon Kwata 010, where 285 ballots unaccounted for under Namu RA 11;

 

vii. Kwari I, 021 where 6 ballots were unaccounted for under Namu RA 11 ;

A declaration that the election held on the 9th March 2019 conducted by the 1St Respondent was marred by irregularities which were substantial and has substantially affected the outcome of the elections.
