Justice Agishi Of Jos High Court Transfers Matter Awaiting Judgement Against DSS

One Musa Ibrahim Umar, has filed a suit through his counsel, Barrister Akibu Idris  No.FHC/J/CS/18/2016, against the Department of State Security Services (DSS), seeking for the enforcement of his fundamental Human Rights.

The suit was before Jos division of Federal High Court 1, presiding over by Justice Docas V. Agishi, also seeks for the transfer of a matter, against Department of State Security Services (DSS).

The matters which came up for ruling on a motion and judgement, but   could however, not see the light of the judgement as expected to be delivered by the presiding judge.

The plaintiff is accusing the DSS, of unlawfully invading his privacy at, Uyamadu Street, in Bukuru of Jos South LGA in Plateau State, at about 4:30pm, while he was asleep on the 2nd March, 2016 and also, “shot at him on his right lower arm.”

Umar, is also seeking the court to declare the DSS actions as unlawful and to further grant an order compiling the defendants to pay the sum of N10m, as compensation to the injury and permanent disability inflicted on him, resulting out of the gun shot.

However, when the matter came up for ruling on the motion on notice filed by the applicant counsel, Barrister Idris, to allow both applicant and respondent to address the court orally on the point law,  based on the amendment of the defendants affidavit, justice Agishi, ruled that the matter will be transfer, for the sake of her integrity.

The plaintiff counsel Idris, had filed a motion challenging the respondents counsel, for amending their processes, behind him, which he contended that the said amendment goes against the applicant’s right to fair hearing.

In her ruling justice Agishi, said she will transfer the case file to the CJ federal high Court for the reassignment of same.
