High Court of Justice Jos, Plateau state on Monday has adjourned to 27th November 2020 for hearing on two applications brought before Hon Justice, Arum Ashom of Court 5.
The Plaintiff, Respondent Barr A.B.Cobby told the court the matter for hearing on their suit is ready when the defendant, Objector counsel Prof A.S. Shaakaa raised a preliminary objection on notice of preliminary.
According to prof Shaakaa, they seeking for extension of time because in accordance with law practice the defendant is still within the five days requires of them to file their counter objection.
He said, my Lord, we need to respond to the plaintiff counsel reply on point of law to the notice of preliminary objection on two applications.
However, their notice of preliminary objection dated 9th July 2020 and the second motion on notice dated 21st July 2020 respectively.
Meanwhile, in another suit which came up for hearing counsel to the plaintiff ( Chief Achi Achijoke). Barr Thomas .M.Ochogbo also sued Prof, Mrs, Deborah E.Ajakaiye &2 ors in a suit No PLD/J240/2019.
The matter was also billed for address cum judgment of 14-09-2020 however, the defendant before 14/09/2020 filed a motion on notice on the defendant counsel for an extension of time to enable them to file their defense.
Barr Thomas filed a counter-affidavit and the defendant’s counsel was served with the same counter affidavit in the open court and defense counsel asked for another date.
Based on the above the matter was adjourned to 29th September 2020 to enable them to file a reply to the plaintiff counsel.
