Court Adjourns For Ruling On Hon Ubandoma Laven Against PLASIEC, APC, Lalong

Plateau  State High Court on Tuesday adjourned to the 7th September 2021 for ruling on the fresh application brought before Justice Ishaku Kunda by the Plateau State Independent Electoral Commission, PLASIEC, All Progressives Congress, APC, and Governor Simon Lalong urging the court to dismiss the Chairmanship candidate of the PDP, Langtang North LGA of filing processes.

 

Barr .G.S. Pwul ,SAN, told the court that he has a motion on notice dated 10th of August, 2021 which is the business of the day.

 

He said the motion on notice was followed delay by the circumstances that occur in Jos North LGA that is well known,we have served the claimant /respondent on a single prayer.

 

According to him, the grounds stand on 3 issues and were supported by an affidavit of 13 paragraphs accompanied by a written address to satisfy the rule of this court.

 

Pwul the counter affidavit and the written address filed all by the defendant which application on point of laws was he placed reliance on the recent addresses in support of this motion.

 

He urged the court to take judicial notice of the processes filed by the claimant/ respondent following the urgent notice of withdrawal dated 09-08-2021 which all grounds have been exposed.

 

Garba Pwul explains the claimant’s respondent’s unilateral response, citing authority on Dingari against INEC, stressing that in their suit NO  PLD /J/3321/2021 wrongly filed calling on the court to dismiss the application.

 

While, countering the argument of the defendants, Barr. Harrison Uguala said, we have filed a counter-affidavit and a written address in the position of the application.

 

He noted that his application dated 11-08-2021 which we placed reliance on all the paragraphs of the counter affidavit by adopting as their oral submission in the application.

 

However, Uguala said, the defense counsel only served them this morning urging the court that the matter having been filed today the argument cited by the applicant is not correct the supreme court judgment went contrarily.

 

Ugwuala maintains that the defendant on page 2 replied that across 210 to 213 (E) (B)  the defendants didn’t have any defense here even on their authority cited.

 

He urged that the defendants should not flog a dead horse by calling on the court to dismiss the application on grounds that it’s lacking in merit.

 

The judge adjourns for ruling on the application to the 7th September 2021.
