Plateau PDP Challenges PLASIEC In Court Over Exclusion From Forthcoming LGAs Polls

A Vacation Judge, Justice Ishaku Kunda on Tuesday adjourned to the 5th of August, 2021 for taking of notice of objections and originating summon filed by the People Democratic Party (PDP) challenging Plateau State Independent Electoral Commission, PLASIEC, from exclusion by charging high fees for nomination forms into Chairmanship and councilorship election slated for October, 2021 poll.

 

Justice is handling the trial of PDP challenging the All Progressives Congress, APC, on grounds of exclusion for participating in the forthcoming election slated for October by PLASIEC.

 

However, this medium gathered that under section 4 of the 1999 electoral law PDP where factional leader Hon Bitrus Kaze obtained a judgment restraining the Hon Chris Hassan led faction from parading themselves as the Exco of the PDP Plateau state chapter.

 

It would be recalled that the PLASIEC conducted the election sometimes in 2019 which usher in the dissolved councilors and chairmen to pave ways for a fresh October 2021 poll,”

 

Our correspondent gathered that the Plateau State House of Assembly had already intervened into the exclusion of PDP candidates by calling on the PLASIEC to allow them to participate in the exercise when the matter came up for mentioning, The PDP crisis is presently undergoing the processes of reconciliation by the NWC by National Chairman, Hon Uche Secondus.

 

They have alleged that the APC is plotting through the PLASIEC to exclude them completely from participation and also to destabilized ahead of the poll knowing the capacity of PDP supporters in the state, he added.

 

The counsel to PDP, Barr. Edward Pwajok, SAN, the claimant /Applicant told the court that they’ve filed an originating summon which was duly as served on the respondent (PLASIEC), we also filed a motion on an interlocutory injunction which was duly served on the respondent, PLASIEC,

 

Pwajok, SAN, says the respondent has responded to their motion by filing in counter-affidavit and served on them when the claimant filed our counter-affidavit for further and better affidavit together with an address.

 

“My Lord, just on the 26th July 2021 we filed our notice of preliminary objections yesterday evening the defendant (PLASIEC) the projector did their own and the motion is ripe for hearing and we are ready to proceeds with the business of the day “, Pwajok, SAN.

 

While responding, G.S Pwul told the court that yes it is right that we have been served with their interlocutory injunction order and we have responded but however, on 23-07-2021 we filed a notice of preliminary objections challenging the competency of the suit and the trial before the judge.

 

He said the claimant, applicant motion to the defendant( PLASIEC),, Pwul urged the court to take judicial notice accelerating hearing on the timeline of the proceedings that the injunction order is a waste of time.

 

Earlier, Pwajok, SAN, disclosed that on behalf of his client they’ve approached the court to stop PLASIEC from excluding his client which he said is crude and bad to deny them that action is unconstitutional and violation of international
