Kabong Upper Area Court Grants Substituted Service To JED PLC &  Adamu Mohammed

An Upper Area Court sitting in Kabong the  Plateau State has granted a substituted service to be serve on Adamu Mohammed whom bailiff alleged he rejected service on him in a suit filed by Bello Kabiru (complainant ) challenging Abdullaziz Adedeji ,Ist defendant ,Mujitafa Nasiru 2nd defendant and Adamu Mohammed the 3rd defendant .

Counsel to the plaintiff ,Barr. Yusuf Ali told the court that the three accused persons standing trial of direct criminal conspiracy and civil disobedience to his client fundamental human right which is dated 8th day of March ,2023 and filed on 9th day of March ,2023 .

However ,after moving the motion attached with exhibits of destruction by the three accused persons Justice Bingjing granted the prayers as prayed by the plaintiff counsel Barr.Yusuf Ali .

According to him ,the complainant is the owner of  the premises located at Adamu Nyam ,Atiku Street Rayfield Jos and the defendants are staff of the Jos Electricity Distribution PLC .

Ali told the court that the three accused persons on or about the 6/3/2023 ,the defendants without the permission or consent of the complainant committed the offense of criminal trespass by entering into the said premises of the complainant climbed the electric pole power to his premises from the electric pole opened the sealed meter broke the seal inside the meter box .

He said all in the absence of the complainant and thereafter turned round and falsely accused the complainant of meter by pass and thereby disconnected the electric pole power that supply the complainant said premises since the 6/3/2023 up to date without any justifiable cause .

Ali explained further that the complainant states he has admissible ,sufficient and reliable evidence to show that the defendants have committed the offense of criminal conspiracy punishable under section 59 (ii) criminal trespass under section 133(iii)  criminal defamation punishable under section (ivl mischief punishable under section 313 all of the Plateau state penal code law of 2017 .

The court further adjourned to the 17th Match, 2023 for criminal trespass, civil disobedience same date as the complainant claiming N300,000 damage caused to meat ,fish ,fruits for unauthorized disconnection to the building for mental anguish ,inconvenient ,embarrassment by wrongful act of the defendants .
