Hon.Ismail  Abubakar Petitions EFCC, Nigeria Customs Service Over Illegal Invasion Of His Residence That Caused  Wife’s Miscarriage

A customs officer ,Mr  Ado Abdul-Hamid has been accused of allegedly conniving with the EFCC to invade one Ismail Adam Abubakar residence claiming non remittance of N35 million, even as the funds were directed paid into the account of NATCOM or Nitel/ Mtel trustee Ltd now in liquidation as the first claimant.

One Mr. Ismail Adam Abubakar of Jos North Local Government Area of Plateau State has petitioned the Comptroller General, Nigeria Customs Service,(NCS)  against customs Senior Officer, Ado Abdul-Hamid and the Chairman Economic and Financial Crimes Commission(EFCC) HQ for unlawful invasion of his residence at Dogon Dutsi Aguwan Rukuba leading to miscarriage of the second wife’s pregnancy.

In a petition against the senior officer Ado Abdul-Hamid, Ismail Adam Abubakar said he was an agent between Nitel /Motel Trustee Ltd which company was liquidated and the customs officer Ado Abdul-Hamid used his company Iliya Haladu (chemical) in selling a landed property situated at Birnin Kudu, Jigawa State.

The transition was successfully completed without any issue until the Claimants were unable to deliver possession of the said property to the defendants due to the pending case before a Federal High Court.

Ismail Adam explained further that Nitel/Mtel raised the alarm that instead of waiting for the outcome of the litigation, Mr. Ado Abdul-Hamid went ahead using EFFCC to harass and intimidate him by invading his household without any warrant of arrest issued on him.

He lamented that the Nitel/ Mtel which is now in liquidation explained the reasons why the buyers, that is, Iliya Haladu Chemical and Ado Abdul-Hamid pursuing his life after the Federal Government, Nitel/ Mtel, and other stakeholders were still discussions in respect of the property, and the defendants were fully informed by his counsel.

However, Ismail Adam Abubakar in a petition against the EFCC by his counsel read, thus “Our client disclosed that the Kano State zonal office dated on the 5th October 2023 of the pending suit and enrolled order of the court in suit No , PLD /J519M1/2023 (1) Nitel/ Mtel trustee (in liquidation) 2 Ismail Adam Abubakar Vs illiya Haladu chemical.

Despite the notification to the EFCC Kano , on the 19th day of October 2924 at about 12:40pm the said EFCC Kano zone along with civil defence personnel Jos command invaded his residence to arrest him without any search warrant.

According to Ismail Adam Abubakar,” the operation was led by one Mr Innocent Oko , and lion,lion cause damaged to his building and scattering the wives properties claiming to be in search of him .

He said, with the experte order dated and filed on 15/09/23 , attached 17 paragraphs affidavit in support ,the grounds upon which the application is brought and the written address praying the court for the following:

An order granting leave to issue the writ of summon within the jurisdiction of the High Court of Plateau State and to serve same outside the jurisdiction of the High Court of Jigawa State.

Secondly, a declaration that the 2nd claimant has done no wrong to any of the defendants .

A declaration that consequently the defendants have no valid or legal right to cause the arrest of the 2nd claimant by the department of DSS ,the Nigeria Police Force ,the EFCC or any security outfit in the country.

An order of interim injunction restraining the defendants , their agents ,privies , officers /staff , workmen or any other person howsoever and whosoever described from committing further threats by way of telephone calls social media , verbally by themselves or through any other person or means against the 2 ND claimant , until the motion on notice for interlocutory injunction already filed is determined
