High Court In Yola Restrains State Assembly From Suspending A Lawmaker

Adamawa-HAA  High Court in Adamawa presided over by Justice Ambrose Mammadi, has granted an Interim Injunction restraining the state assembly from suspending the member representing Mubi South Constituency, Abubakar Abdulrahman from the House.

 

The court also restrained the House from dissolving its standing Committee on Finance, Budget and Appropriation chaired by Abdulrahman pending the determination of the motion on notice.

Recalled that Abdulrahman who  has dragged the Speaker of the House, Hon Kabiru Mijinyawa and the Assembly  before the court over his suspension for three months and the dissolution of his committee following a press briefing he (Abdulrahman ) granted where he  criticized the  House for  approving N11 billion sectoral virement in the state 2015 budget.

Justice Mamadi while granting the injunction, noted that ” From my reading of these processes, I am of the opinion that applicant has made a case for the grant of the application herein. Consequently I grant the application as prayed.  I make the following Orders.

” An interim Injuction restraining the defendants from carrying into effect the pronouncement of the 1st defendant dissolving the House Committee on Finance, Budget and appropriation made on 10th November, 2015 pending the hearing and determination of motion on notice.

“An Order of interim Injuction restraining the defendants from suspending the plaintiff in this matter from Adamawa state House of Assembly pending the hearing and determination of the motion on notice in this matter.

” An order that the motion on notice be served on the defendants.”

Meanwhile, Abdulrahman who expressed satisfaction with the court order has urged his supporters and members of his constituency to remain calm as he would leave no stone unturned in providing them with the needed quality representation.

” What happened to me is part of the challenges one has to face for being vocal. I want my people to know that I am there for them and the positive change our great party APC represent”, Abdulrahman said.

In a reaction by the Chairman committee of Information of the House of Assembly, Hon. Hassan Mamman Barguma said the Court has not power to stop the decision of the Honourable House.

“It is only an injunction the court has given, it is not a judgment so the injunction did not overruled the decision of the House”. Barguma said

Barguma continue to say that: For the court to equally gave an injunction over the dissolution of all committee including the committee on Budget and appropriation is been chaired by Abubakar Abdulrahaman, it is a judgment to reverse our decision

“Mind You the member was not voted in as chairman committee on Budget and appropriation, but was voted in as a member to be representing Mubi South, being a chairman of any committee is not a right is a privileged, beside the House has the right not to give him any committee to chair” He added
