Falana Files A New Urgent Application To Get Sheikh Zakzaky Out For Medical Treatment

Mr Femi Falana SAN, counsel to the embattled leader of the Islamic Movement in Nigeria, Sheikh Ibrahim El Zakzaky has filed a fresh Application of urgency before the Federal High Court Abuja, praying for the court to grant El Zakzaky speedy access to medical treatment in the United Kingdom. The application was filed on the 30th day of August, 2016.

In this latest Application, Falana informed the court that the Applicant has already lost one eye through gunshots fired at him by the Nigerian Army on 14 December 2015 when armed soldiers invaded his residence at Zaria, Kaduna State. He further disclosed that there is the fear that he can lose the remaining eye and thereby can go blind completely if the applicant is not urgently freed to seek medical care abroad. He therefore urged the court to move swiftly and save the Applicant’s sight.

It will be recalled that Falana filed a suit seeking the enforcement of the fundamental rights of Sheikh El Zakzaky in the Federal High Court in Abuja following an attack at his residence in Zaria by the Nigerian army, during which he lost three children as he and the wife were fatally injured. He has been in the custody of the Department of State Security (DSS) incommunicado ever since with limited access to his immediate family  as they claimed to be holding him in “protective custody”.

The matter is before Justice Gabriel Kolawole of the Federal High Court in Abuja. Earlier, a motion seeking for the vacation judge to continue with hearing during the court vacation was dismissed on technical grounds.

A date is yet to be fixed for this fresh application.
