The National Assembly Petition Election Tribunal on Tuesday dismissed petition brought by the People Democratic Party, PDP, candidate for Pankshin , Kanam and Kanke Federal Constituency as it upheld the victory of Hon Yusuf Babayo Gagdi of the All Progressive Congress ,APC ,on the grounds that the petitioner failed to prove the allegations of mutilation ,alterations ,over voting and noncompliance to the electoral act .
The Chairman of the Tribunal J .I .Nwoye in her Five hours judgment said all the documents tendered in evidence are more of hearsay from the witnesses presented by the petitioner.
According to the Jurist, the petition has exposed the petitioners’ case to an academic exercise stressing that the petitioners had failed to identify the polling units in Kanam LGC which made the exercise constituted on hearsay.
She added that to prove the issue of over voting, petitioners failed to submit the voters register of the 19 polling units in Kanam LGC, including the issues of votes cast.
Justice Nwoye said since the returning officer didn’t cancel the election but suspended the exercise until when the reinforcement of security which is in compliance with the 2010 amended electoral act.
She added that the pronouncement and declaration was done on oral by the returning officer which he said the exercise is in conclusive in five wards.
The judge explained further that where election is nullified for the issue of over voting then calling for this cancellation of result in 14 wards in Kanam is not sufficient enough to warrant for the cancellation under section 140 of the electoral act before embarking on it.
She reiterated that the documents that are tendered were without substantial evidence to speak life on the petitioners proof.
