Court Adjourns To 1st December For Hearing On Suit Filed By Factional APC Chairman In Plateau

Justice S.P. Gang of the State High Court Jos, Division sitting in Plateau State has adjourned to 1st of December, 2021 for the continuation of hearing on All Progressive Congress, APC, inter-party affairs on state Congress held at Crest Hotel where Hon Ishaya Itse led factional group boycotted the exercise as impunity lack of internal democracy and imposition of candidates.
in a suit No,PLD/J500/2021 between Hon.Ishaya Itse, Hon.Dakwom William Danjuma, Timothy Yilmukuah, Nenrotmwa Deyin, Nanman Maimagani Zhattau, and Garba Pankwal Ahuza challenging the All Progressive Congress, APC, Plateau State Executive Committee of APC, Hon Rufus Bature, Hon Fidelis Longban, Hon.Philip A.Adik,Hon Sylvanus Namang ,Hon Barr.Alice Dimlong, Hon Bako Wumanna, and the Independent National Electoral Commission, INEC, through originating summons in pursuant to section 223(1) and 2 (A) of the 1999 constitution in article 13.6 (11) and 20 of the APC constitution of 2014 as amended and orders of Plateau state high court civil procedure rules 2020.
Counsel to the claimants, Barr. N.D .Gwalson told the court that the matter was slated today for mentioning of originating summons dated 25th October 2021 and filed on the 27th October 2021 and all respondents are served with the processes.
He moved the motion, However, counsel to 2&8 defendants, Barr Garba S.Pwol opposed the claimant/Applicants motion saying we had the 1st defendant served on the 5th of November, 2021 while the 2&8 defendants were served on the 8th of November, 2021 with the record on the ground shows under rules 23 of 2020.
Pwol explained that they are still entitled to seven days to respond to its particular rules 3 of this honorable court , adding, therefore, my lord, my clients are still within time in accordance to the motion rules.
The counsel to the 1st defendant INEC,Barr. O.Olekwal said as a nominal Party the matter is inter-party affairs in view of the fact we enjoy standing outside and we didn’t intend to file any processes we can only abide by the order of the court position.
Gwlason said yes, it is right of the 1&8 to file their counter affidavit, so their time is running and I don’t oppose to the applications.
The claimants sought for six reliefs, that the claimants herein withheld their consent and or refused to step down for the 3rd to 8th defendants herein in the 1st defendants state Congress in Plateau state fixed for 16 October 2021.
That the 3rd to 8th defendants didn’t pass for consensus candidates and can’t be described as consensus candidates, he said.
