Contempt Of Court: FHC Lafia Adjourns To December 6 For Hearing Of Applications

The federal high court sitting in Lafia, the Nasarawa state capital has adjourned the case between Bar Labaran Magaji Versus Arc Ahmed Tukur.

The Judge, Justice Nehezina Afolabi declared that the adjournment will enable her to hear all the preliminary objections and motions.

The counsel to Bar Labaran Magaji, Gali Umar in his submission told the court that is back to the court to brief the judge on the ability of the court to conduct a fresh primary election within 14 days..

“I’m in this honorable court to brief you that the election did not hold within the stipulated time”.

The defense counsel, Bar Aminu Maifata in his submission told the court that the FHC, Lafia has no jurisdiction to entertain such a matter

“I have a preliminary objection (PO) challenging the jurisdiction of the court to entertain such matter”.

He further explained that he has a motion of stay of execution, challenging the judge of entertaining such a matter.

The judge, Justice Nehezina Afolabi averred that she will use a. day to hear all applications at a time.

The defense counsel, Bar Aminu Maifata in an interview shortly after the adjournment, insisted that the FHC Lafia has no mandate to go on with the matter.

Our case number is 09 at the appeal sitting in Makurdi, it could be recalled that the federal high court sitting in Lafia nullified the primary election for the All Progressives Congress (APC) Nasarawa west senatorial district.

The FHC, Lafia on November 2, directed the national chairman of the ruling party to fix two weeks for the conduct of a fresh election.
