Federal High Court  Lafia To Pass Contempt Of Court Judgement On APC National Chairman, Secretary

The Federal High Court sitting in Lafia the Nasarawa state capital under the lordship of Justice Nehizina Idomudia Afolabi has set aside Thursday the 8th of December to deliver a judgement of contempt of proceedings filed by Bar. Labaran Shuaibu Magajii the APC senatorial aspirant for Nasarawa West senatorial district against senator Abdullahii Adamu and senator Iyiola  Omisore the national chairman and national secretary of the APC respectively.

It would be recalled that on November 2 the federal high court passed a judgement ordering APC to re-conduct a fresh primary election between Barr. Labaran Shuaibu Magajii and Arc.Shehu Tukur within 14 days, but along the line the said election could not hold, prompting the complainant to go back to court.

Briefing newsmen immediately after the hearing within the court premises on Tuesday, counsel to the plaintiff Barr. Gali Umar said,” the reason for our being in court is to hear the contempt proceedings filled against the national chairman of All Progressive Congress APC, Senator Abdullahii Adamu and the national secretary of the party for refusing to adhere to the order given by this honourable court.

” The two applications filed by the defendants, the application for the preliminary objection to the contempt proceedings and the motion for stay of execution are considered to be an afterthought. You don’t file an objection to contempt proceedings because that is an affront to the court has been in contempt in the first place.

Secondly, the motion for execution comes during when the defendants are already in disobedience to the court order. what they ought to have done was to fill it on time, but now filling it while they were in contempt, they deserve no favour from the honourable court”.

According to him, the court proceedings would not distract his clients no matter the period it may last, saying that his client’s campaign ahead of general elections to succeed senator Abdullahii Adamu’s vacant seat remains secondary.

“Campaign is not important what is important is to do the right thing. what we are doing is to see that the party is in the right position to enable people to know that APC is a great party that has rules and regulations.

 And anybody that violates such rules the law will catch up with him and that is the effort that we are putting in” Barr. Umar stated.

On his part, counsel to senator Abdullahii Adamu and National secretary of APC Barr. Muazu Maifata said, “we moved our preliminary objection challenging the jurisdiction of the court that it has no jurisdiction to entertain committal proceedings against the national chairman and national secretary of APC because notice of appeal has been filled in the appeal court.

” We inform the court that your Lordship doesn’t have the jurisdiction to proceed with any issue filled before the FHC Lafia. they should wait after the determination of the appeal before they would take other steps”.
