Two Convicted For Internet Cybercrime In Plateau

Two persons were on Thursday convicted of cybercrime criminal offense as they pleaded guilty of committing the crime that is punishable under section 309 of the Plateau State administration of criminal justice act.

 

Justice Christine Dabup of the Plateau State High Court No 3 handling the prosecution of criminal justice sentenced Mr. Chinaza Miracle Obida alias James hit and  Obadare Obayemi to one Month in prison (a correctional center)  or pay a fine of N120,000.00 for cheating and defrauding an American girl of the sum $989 as he promised to marry her name (Rose Kate).

 

The accused person (Mr. Obadare Obayemi ) who is standing trial presented himself as an American citizen’s resident in Africa for which he was arraigned under section 369 punishable by section 308 of the criminal justice law of Plateau state administration.

 

The prosecution counsel, Barr. S.N Robert told the court that the accused person has already pleaded guilty to committing the crime and should be convicted by sending him to the correctional center pursuant to section 284 administrative criminal justice law.

 

 

The defense counsel Barr S.O. Obiare said since the accused person has pleaded guilty and volunteering to refund back all the money, bargaining, in law, the practice of negotiating an agreement between the prosecution and the defense whereby the defendant pleads guilty to a lesser offense or (in the case of multiple offenses) to one or more of the offenses charged in exchange for more lenient sentencing.

 

Defense counsel says the accused person, Mr. Obayemi under section 284  plea bargain claim that the court should reduce conviction, whereas preventing justice from being served.

 

 

He explained that negotiations, agreements were reached with the complainant.

“However, the accused person begged for plea bargain which all funds have been returned because the defendant lost his father and dropped out of school at the University of Ilorin, Kwara state and now he promised to change to a new way of life.

 

The accused person started as a jock but when he received the alert he couldn’t spend the money and refunded it back to the complainant. However, the investigation revealed that the accused person hasn’t jumped bail condition since he was granted bail.

 

The two students committed the offense through an internet boy and girlfriend’s relationship and they all disguised themselves as American citizens by using fraudulent means to extort money through internet frauds.

 

 

Meanwhile, in a related offense punishable under section 309, in a suit No PLD/J70C/2021  one Chinaza Miracle Obida alias James hit has duped an American girl, Miss Nancy, Jerry, claiming that he is a soldier with American army fighting in Afghanistan and is in need of financial assistance and promised to marry her after concluding his assignment.

 

However, Justice Christine Dabup sentenced Mr. Chinaza Miracle Obida to 3 months or pay a fine of N180,000.00 because he has paid through a plea bargain and he refunded it back to the complainant.

 

The prosecution counsel Barr. S.N Robert told the court that the matter was slated for the arraignment of the accused person on one count charge.

 

The charge was read by the accused person and he pleaded guilty to committing the crime the money of Miss Jibrila Anabinou when converted is amounting to #500,000.00 punishable under section 309 of the penal court of 2017.

 

The accused person counsel Barr H.M.Nuhu pleaded for leniency for his client, for which he has shown remorse and already plea bargain which money was returned.
