Trial Resumes On Shehu Jatau ,Nanjul Isah ,2 Ors Over Wase LGA Killings

The Trial of Shehu Jatau and Three others on alleged criminal conspiracy, culpable homicide, and kidnapping has resumed for the continuation of hearing with two witnesses testifying before Honourable Justice P.S.Gang on Monday at Plateau High Court.

 

Justice Gang adjourned the case to the 18th February 2021 for the taking of more witnesses and taking of the application for bail presented to the court by the defense counsel.

 

The defendant’s counsel, Prof Sylvester told the court that he has a motion on notice before the court which is dated 10-12-2020 and filed on 11-12-2020 asking the honorable court to admit the accused person’s bail which the application for bail is supported with an affidavit that was disposed of by S.P.Panwal &co.

 

He said, he is relying on the affidavit in support of his application also supported attach is a written address to the application.

 

Secondly, according to him, in reactions to the counter affidavit of the plaintiff he also filed a further and better affidavit dated 4-01-2021 also attached to the further and better affidavit is a written address where he adopted the written address in the main application for that of further and better as their solution in this application.

 

Prof Sylvester urge the court to grant them the bail application .the applicants formulated one for determination, however, it’s in the interest of justice to grant them bail.

 

He appealed to the court that the accused persons have been in detention for almost one year plus, where they transfer from STF back to police headquarters in the circumstances, section 36(5) of 1999.

 

Prof Sylvester pledges that the accused persons plead innocent and they should be released on bail pending the determination of the suit and he promised to present credible evidence to sufficiently prove his prayers.

 

In response to the application for bail of the defense counsel, the plaintiff counsel, Barr Edwin A. Inegbenoise presented 17 paragraphs dated 16-12-2020 and was filed alongside a written address including a counter affidavit to highlight guidelines for the application for bail in a case of BamidiVs State.

 

The second phase of the written address was when the supreme court emphasized that the accused persons standing trial in the offense committed might commit another crime under section 177 of the Plateau state criminal justice provided that the defendants are a capital offense.

 

Barr Edwin cited the case of Adamu Usman against the Commissioner of Police that the accused persons should not be granted bail and the court should dismiss the application owning to the gravity of the crime committed by the four accused persons.

 

One of the witnesses, PW1, Mr. Jinan Nimmyel a traditional worshipper who residence in Lamton of Kadarko district of Wase who escape death through several wounds injuries inflicted on him by Shehu Jatau and Nanjul Isah the accused persons said he recognized the two accused as the ring leaders that are perpetuating the act of maiming, killing, and brutally murdering residents of the community.

 

 

He disclosed that Shehu Jatau and Nanjul Isah drove by Nanjul Isah at about 3 pm of May 2019 raids their home in Lamton and killed 4 persons while he was chased by them up to  Pegai community where they arrested him,  he saw two members of Lamton and Shehu ordered us to be tied with ropes and one other person now deceased, late Bani was tide around and they set fire on him when he was crying and begging them until he finally died in pains.

 

Then, Shehu, and Nanjul Isah shots at me and one Danlami who died instantly, while they shot me at close range on my head, chest, and months with guns with several bullets that spear through my skull and I survive it through the help of foreign doctors who battle to safe my life.

 

However, they rushed me to Langtang North General Hospital where I was attended to by the doctors that treated me.
