Plateau High Court Reserves Ruling On Dr Nentawe Motion Seeking To Join Delegates

The Plateau State Court on Thursday has reserved its ruling in the suit filed by purported delegates of the 2023 primaries election as the application scale through the first bundles of proceedings in Justice Arum Ashom .
Justice Ashom application announced that the date for its ruling had been reserved and adjourned to 2/11/2022 when he granted the counsel to Dr Nentawe Yilwatda ,Barr.A.G.Yirvong was allowed to present his argument why he wants to join in the suit
However, Barr. Yirvong told the court that his client who is currently the flag-bearer of the APC came through a motion seeking to join delegates as a defendant whose application was filed on 14/11/2022 within that he file an affidavit on point of law and the same was served on parties and ripe for him to proceed
The motion was not opposed by Barr.S S.Obende counsel to the All Progressives Congress,APC, and the judge granted the application which had to be argued by the claimant’s counsel.
Then, Dr Nentawe counsel,Barr. S.A.Abbah the motion dated 24/10/2022 and filed on 25/10/2022 was seeking the following reliefs contained in pages 1&2 of the same motion and supported is banned copies of 18 paragraphs affidavit he relying on all the issues contained also attached is exhibit A&B in compliance with the rule of this court attached to that is a written address.
Yirvong asked the court to graciously grant the application as served, the claimant counter affidavit, we have reacted with a further affidavit and replied to them on the point of law dated 14/11/2022. My Lord , we place reliance on the affidavit and also adopt on the point of law by urging the court to grant the application.
The counsel to the petitioners Barr.S A.Abbah raised objections that the application of Dr Nentawe can’t scale through because they’re not filing to challenge the outcome of the primaries election that produced him as the sole candidate
Yirvong argued that his client who won the APC primary is a product so the suit attached so much interest and therefore became very necessary for to join as a party.
Adding that his client’s presence on this will give him confidence so,Obende refuses to oppose the application saying it would give chance for protecting his candidacy which the claimant is challenging in court .
Barr .Abbah vehemently opposed by filing a counter affidavit dated30/10/2022 with 4 paragraphs affidavit accompanied by a written address which he adopted in furtherance to his argument.
He explained that the suit of the claimant is challenging the exclusive function of the APC as a political party so the Dr Nentawe is not an officer in this suit and our position cost of action from the claimant accrued before the Dr Nentawe became the APC flag bearer.
Abbah stressed they have been canvassing this suit, which was even filed before the election the issue in contention is that we urge the court to reject the application.
Yirvong argued that the claimant is speaking on the amended originating surmount dated 9th September 2022 and taking effect before 24th May,2022, we responded which is predicated on his amended application seeking to join.
The following claimants include Mensuk Boniface Dieyen,Kwamkur Fadip Kpaknim,Dabol Yakubu Taro,Danjuma Abere ,Faith Izang Azumi,Fwangshak Samuel Tungkir ,Podos Pius ,Lapa’am Musa Titus ,Philemon Zachariah ,Tabitha Maze Ajang Vs APC &Dr Nentawe Yilwatda .
