Nigeria Army, Police Denied Custody Of Two Persons Detained 13 Months After By Rabiu Omaku,Lafia

The counsels to Nigerian Army and the Police denied the custody of first and second applicants, Tanko Ibrahim (Mal.Tanko) and Adamu Ibrahim (Mal.Adamu) after one year of unlawful arrest and detention.
The First, Second, third, fourth and fifth respondent denied keeping custody of the applicants instead buttressed that they arrest and handed over the culprits to the state security service (SSS) .

The presiding Judge, Agatha Okeke directed the counsel to the first and second applicants to serve a counter affidavit to the state security service to enable the service appeared in court.

The counsels unanimously agreed for the adjournment of the case to 25/3/2015 for proper hearing, The counsel to the applicants in an interview expressed optimism over the progress of the case.

“I’m hopeful that the applicants would regain their freedom as N20m damages was claimed by the family members and petitioners”.

Counsel to the applicant, Ahmed Loko while commenting on the non-appearance of counsel to SSS said the court has the legal right to discharge and acquaint the applicants in absence of the SSS before a competent court of jurisdiction.

It was a melodrama as counsels to Nigeria Army, Nigeria Police, Commissioner of Police, Nasarawa state, Commandant 177 Guard Brigade denied the custody of the prisoners

It could be recalled that on 28/2/2014 a joint security operatives pounce on Tanko Ibrahim ,Staff of Local Government Education Authority (LGEA) and whisk him away, Other person arrested also include Adamu Ibrahim (Mal Adamu) was nab at his father’s compound at the early hours of the day following a gunshot injury on him while attempting .
