You Must Resign Transparency Group, SERAP Tells Dogara

The Transparency Group members in the House of Representatives have told Speaker Yakubu Dogara that he must resign.

Speaking in a statement issued yesterday the group said; “We hereby reiterate our call on Rt. Hon Yakubu Dogara to resign in order to pave way for proper investigation.”

The group said it made the call following Dogara’s  reaction to budget padding in his first public comment on the scandal.

The statement  titled : “How Dogara Padded 2016 Budget” was signed by Bashir Baballe, Member Representing Ungogo/Minjibir Federal Constituency of Kano State, Agunsoye Oluwarotimi Ojo, Member Representing Kosofe Federal Constituency of Lagos State and Abubakar Chika Adamu, Member Representing Shiroro/Munya/Rafi Federal Constituency of Niger State on behalf of the 206 Members of Transparency Group.

It said “Members of the Transparency Group are appalled and deeply shocked to hear the Speaker of the House of Representatives, Rt. Hon. Yakubu Dogara, exonerating himself from the budget-padding scandal raging in the House.

“For a person of Speaker’s standing to have the temerity to come out publicly in defence of an action that is clear negation of federal character principles and breach of trust is both disappointing and dishonorable.

“The Speaker’s comments also endanger the spirit of the oneness of Nigeria.

“We gave the forgoing background to stress the criminal aspect of the Speaker’s action, which is against the letters and spirit of the constitution he swore to protect.

According to the group, “The general public should note that Speaker Yakubu Dogara made criminal insertions (otherwise known as “budget padding”) to the tune of over N3billion to his constituency alone.

“While the entire Zonal Intervention for the three (3) Senatorial Districts of Bauchi State and 12 Federal Constituencies in the state amounts to N1,666,666,666, the Speaker criminally inserted about 200 percent of the amount, totaling N3,079,000,000 to his constituency alone!

“The same Speaker Yakubu Dogara diverted 50 percent of the total Capital Projects allocated to Bauchi State to the tune of N4,781,003,431 out of N9,231,289,842 allocated to the state to his constituency.

“If the above breach of trust and infringement of the Nigerian law are not criminal acts, the “insertions” of bogus projects aimed at siphoning public funds like vague “Youth Empowerment” to the tune of N450million and “Strategic Youth Empowerment” to the tune of N500million should be.

“The Speaker should explain to the general public the difference between “Youth Empowerment” and “Strategic Youth Empowerment” if it is not a fraud. Every discerning mind knows that this a riddle to hoodwink the general public against scrutinizing what is clearly a fraud.

“In the light of the above issues, members of the Transparency Group believe that any attempt to shy away from these criminalities without squarely addressing them is tantamount to legalizing corruption.

“We therefore call on our Honourable colleagues to toe the path of honour, integrity and yearnings of our constituents to avoid signing “Vote of Confidence” on the leadership of the House.

“The onus lies on the Speaker to come clean out of these allegations before we start exposing the sleaze and corruption surrounding the internal budget of the House.

In a related development, the Socio-Economic Rights and Accountability Project (SERAP) has faulted the claim by the Speaker of House of Representatives Mr Yakubu Dogara that “budget padding is not a crime under Nigerian law.”

Mr Dogara said this after a meeting with President Muhammadu Buhari at the presidential villa last week. According to him, “Budget padding is not an offence. What is padding? I studied law and I have been in the legislature and all this period I have never heard of the word padding being an offence under any law…Why should I be worried. As far as I am concerned, I am not worried over anything.”

But in a statement today by SERAP executive director Adetokunbo Mumuni the organization said that, “Budget padding in fact is corruption, as it is implicit in corruption offences such as abuse of office, attempt to embezzle, divert, and misappropriate public funds, conspiracy to act corruptly, and illicit enrichment, which are recognized under the UN Convention against Corruption to which Nigeria is a state party, and included in national legislation such as the Corrupt Practices and Other Related Offences Act, the Economic and Financial Crimes Commission Establishment Act and the Fiscal Responsibility Act.”

The statement reads in part: “The allegations against Mr Dogara and other principal officials of the House of Representatives also suggest a subversion of the budget process, which in itself is a crime but also a fundamental breach of constitutional provisions and an affront to internationally recognized human rights.”

“A prima-facie case of corruption is established when elected officials are allegedly influenced to act contrary to their obligations of office by the prospect of financial gain to themselves. Budget padding also amounts to corruption as the action is against the public interest. Any appearance of corruption in the budget process can result in a cynical public to losing interest in political participation altogether. And democracy can’t work unless Nigerians have faith in those who govern.”

“If Mr Dogara refuses to resign to allow for effective and transparent investigation and the allegations of budget padding are swept under the carpet, the ability of the House of Representatives to function as a watchdog and credible guardian of the public interest would be seriously compromised.”

“The allegations of budget padding and abuse of office by the Speaker and principal officials of the House of Representatives have continue to outrage the public, bringing the House’s integrity further into question.”

“Mr Dogara therefore has a duty to explain to Nigerians the role he played in the alleged budget padding in the House and abuse of office if the growing perception of corruption in the House is to be addressed.”

“Nigerians would like Mr Dogara to explain how the funds meant for legislative functions to service guest houses were spent. Nigerians would also like Mr Dogara to explain allegations that favours were sought from multinational companies including the allegation that a construction company was compelled to carry out some work at his Asokoro ‘plot’.”

“The truth about the alleged budget padding and abuse of office cannot be kept from the public, and treated as an internal matter or a case of see no evil, speak no evil.”

“The more the leadership of the House of Representatives recoils and resists Nigerians’ calls for investigation and accountability for those involved in the alleged budget padding and abuse of office, the more Nigerians will turn on the House of Representatives, and the calls for those involved to step down and for an independent and transparent investigation and prosecution will only get stronger.”
