Legal Tussle: Restraint Gov Al-Makura From Further Demolition Of Breeze Fm—Counsel To Radio Station

The presiding Judge of High court 4 sitting in Lafia, Justice James Abundha has fixed 21 of July for the hearing of the case filed by the management of Breeze 99.9 FM Lafia against the Nasarawa State Government over the demolition of the station.

Ulegede counsel to Breeze FM moved a motion exparte seeking the court to ‘restrain the state government from further demolition on the property housing the demolished radio station.

The presiding Judge, Abundha directed that all parties should maintain status quo pending the determination of the motion on notice.

“The write of summons, the motion on notice and the orders hearing made are to be served on the respondents (Government) forthwith.

“The time for filling of any process in reaction to the motion on notice by the respondents is abridged by three days and the time for filling reply on points of law by the applicant (Breeze FM) is also three days.

“The respondents must file and serve their process before Monday July 17 while the applicant must file and serve their reply on points of law on or before Thursday 20, July 2017,”

The counsel to Breeze Fm 99.9 also seek that the court to restrain the government from interfering with the affairs and the activities of the owners of the radio station pending the determination of the case.

The state government demolished the radio station on May 20, over alleged violation of land approval.
