How I Was Denied Participating From APC Primary In Wase -Hon Yahaya Adamu

The fallout of the All Progressives Congress,(APC) in Wase Federal Constituency of Plateau State , Member Representing the constituency the state Assembly an aspirant in the just concluded primaries, Hon Yahaya Adamu Mavo has dragged his Party, APC, Deputy Speaker,

Rt. Hon. Idris Ahmed Wars, and the Independent Electoral Commission, INEC before a Federal High Court, No1, Jos Division for irregularities, impunity, and lack of due process in the conduct of the Congress held.

Adamu Mavo through the counsel, Barr. Vincent Orifummishe told the court that the matter came up for mention and all parties have been duly served with the processes.

The 1, 2&3 defendants, the 1st defendant All Progressive Congress (APC), 2nd defendant, Rt.Hon. Idris Ahmed Maje Wase and then INEC respectively their counsel admitted receiving the service of the motion on notice from the plaintiff counsel.

The 1st defendant counseled Barr. M.O. Omogu told the court that he has a pending application dated July 15th subject to the overriding convenience of the court and the 2nd defendant Barr. Sunday Obende also filed his client application dated 15th August 2022 and he moved the motion too.

Vincent told the journalists that the matter came up for mentioning and we have received all the defendants’ counter affidavits and two of the defendants yesterday the 2&3 served us with their preliminary objections challenging the competency of the suit what you see happening in court was the moving of their motions which was filed out of time.

He explained that, as counsel to the plaintiff, we have the right to respond to them on point of laws through our counter affidavit which is why the matter sought an adjournment and we can’t oppose the application.

According to him, the whole issue was concerning the primary election conducted in Wase federal constituency, and my client was completely sidelined from the conduct without him allowed by APC to participate in the exercise so he was aggrieved by the action of the party.

He pointed out that the way and manner the exercise went on didn’t follow the due process of conducting party elections in Nigeria.

Barr. Vincent Orifummishile said the aggrieved APC congress purported to have been conducted didn’t take place because my client was not served with pre-notice for the conduct of the election which is not so.

He stressed that we challenged that the purported primary election is a nullity so we want the court to dismiss the election and conduct a fresh election into the seat of Wase Federal constituency rep.

Vincent expressed sadness the thing is this he has done everything required of him, but on the part of the law and the party failed woefully to conduct a proper exercise of allowing Hon Yahaya Adamu Mavo to participate actively in the election.

Responding to the allegations, Barr Sunday S. Obende explained that they moved their application for extension of time which was filed, and their appearances of the time, including a counter affidavit and their preliminary objections challenging the competency of the claimant and the plaintiff counsel, didn’t oppose it.

However, Obende added we oppose the application because the suit is challenging the election of my client Rt. Hon .Idris Ahmed Wase so we have filed against the merits of the application which we are entitled to do so.

He said the presentation which he has given in processes is clearly not correct which the court will determine in the long run.

Obende also stated that his client scored 50 votes out of the 59 accredited delegates and the plaintiff didn’t get any vote cast during the primary yet he is wasting his precious time.

Hon Justice Dorcas Agishi adjourned to the 1st September 2022 for a hearing in the suit challenging the reelection of Hon.Idris Ahmed Wase
