Family Of Turu Goh Drags MTN, Miango Traditional Council, LGA Over Shadyl Land Deal

The Family of Turu Goh are now crying foul over what it termed a shady land deal for a land measuring 3.29 hectares where the traditional council connived to secretly trespassed on the farmland of the plaintiffs.

 

Five members of Muru Ki Mallam Turu Goh of Miango District in Bassa Local Government Council of Plateau state in a suit No /PLD/J/2013 has dragged MTN Nigeria’s communication limited ,Chief Daniel Chega, Miango Traditional council and Bassa LGA to Plateau High Court over exclusion of their family from contract of MTN network mass.

 

The following plaintiffs ,Rubwu Mary Kuiyo (New Waki),Jummai J. Andrew (New Waki) ,Sunday Yah Turu, Joseph R. Turu ,Turu kpasha for themselves and family .

 

The seven years suit which has been lingering on, this medium gathered the defendants kept bringing in excuses waste judicious time of the land owners who donated for community market

 

 

Counsel to the plaintiffs, Barr. Desmond I. Umekwe of No 11 boundary street ,Jos in a writ of summon declared that the piece of land measuring 3.29 hectares situated and lying at Miango district in Bassa LGA of Plateau and more particularly described in the site plan belongs to the plaintiffs.

 

Secondly, an order of forfeiture of the customary tenancy granted the 3rd defendant by the plaintiffs forebears over the 0.18 hectares as identified and shown out of the 3.29 hectares of the land aforesaid

 

Thirdly, an order directing the 1st defendant to remove the network mast illegally built on the farmland of the plaintiffs.

 

Fourthly ,to pay for general damages of N10,000,000.00(Ten million Naira ) against the 1st defendant ,N5,000,000.00 (five million Naira )against the 2nd and 3rd defendant and N5,000,000.00(five million Naira against the 4th defendant totaling the sum of N20,000,000.00 (Twenty million Naira for the trespass ,rancor ,acrimony and embarrassment suffered by the plaintiffs due to the actions of the defendants.

 

An order of perpetual injunction restraining the defendants, their privies and representatives from interfering or in any manner trespassing on the 3.29 hectares of land of the plaintiffs described in the site plan.

 

Justice Christine Dabup was the judge in charge of the case since 2013, as she adjourned the matter for continuation of witness to testify.

 

She said the suit is adjourned to 17th Match ,2020 ,meanwhile, counsel to the first defendant, C.C. Irorakpor was represented in court by S.E. Okoli Esq and that of the 3rd &4th defendants ,O.A.Komolafe urged the court to adjourn the hearing for further witness.

 

The 2nd defendant Barr E.A. Danboyi was alleged to be sick by the defendant who told the court to give him enough time to either change his counsel owning to his ill health.

 

Information available revealed that they always buy counsels to delay the suit in other to frustrate the plaintiffs suit which has lasted for 7 (seven) good years dragging their feet.
