Court Threaten To Dismiss   Hon Damishi Sango Suit If Witnesses Fail To Appear At Next Adjourned Date

Justice Parbong has warned the People Democratic Party (PDP ) under the leadership of the former Minister for Sports and Youth Development ,Honourable Damishi Sango to parade all their six witnesses before the  court or risk dismissal for lack of merit.

Speaking at the JMDB court sitting in Jos North Local Government Council, on Wednesday, Justice Parbong urged the complainant to assemble all their principal witnesses to allow the court forge ahead rather than having constant adjournments.

She said the absence of PDP witness led by Hon Sango in court also stalled the ongoing hearing which suit was filed sometimes in April 8th, 2017 challenging legality of PDP factions leaders of Sen. Ali Modu Sheriff and Senator Ahmed Makarfi .

The judge while adjourning the case to 30th November, 2017 for continuation of hearing stated that Hon Sango now risk losing as a plaintiff if he fails to produce witness against Hon Gyang Badung Chairman of PDP factions leader of Sen Ali Modu sheriff on the next adjourn date .

Counsel to Hon Damishi Sango, Barr. Weng Dalyop told the court that the matter was slated for hearing today, however, their witness are not in court reason being that today coincided with PDP local government state chapter ongoing primaries election for LG poll.

He said the convention involved key officials of the party who deployed most of these witnesses to conduct in respect to PLASIEC guidelines so pleaded for adjournment to enable him assembly all their witness.

Responding, Counsel to Gyang Badung and Emmanuel Macham, Barr. N.N Durven said the constant adjournment has continued to affect his clients whose case was instituted Five months ago.

In his statement ,Durven objected that since they instituted the suit no transaction came up but he is so surprise that plaintiff is now narrowing the sitting to the convention as sad and cheap blackmail .

He pleaded that the complainant should make all signatories of her witnesses to enable him assemble all their principal witnesses for the matter to end.
