A State High Court in Yola has nullified the Local Government and State Congresses conducted by the African Democratic Congress (ADC) in Adamawa State, citing violations of due process.
The decision followed a lawsuit filed by Shehu Yohanna, party’s Adamawa State Chairman, who challenged the congresses for not complying with legal and internal party procedures.
Delivering the judgment, Justice Isa Ahmed ruled that the exercise breached Section 84(4) of the Electoral Act and Article 18 of the ADC constitution. He stated that the organisers failed to follow established guidelines and instead relied on what he described as a self-imposed process.
The court also noted several irregularities, including the failure to give proper notice of the election timetable and the use of an unsuitable venue.
As part of the ruling, the court nullified all congresses conducted while an earlier interim court order was still in effect, stressing that actions taken in defiance of court directives cannot be upheld.
