The Commissioner of Police Plateau State Command has raised a preliminary Objection (P.O) by filing a fresh counter affidavit before a vacation judge , Honourable Justice S.P .Gang of the state High Court seeking an order of the court to quash the plea brought by the Chairman of Langtang North Local Government Council, Dr. Joshua Ubandoma Laven.
Plateau state High Court presided over by a vacation judge, Justice S.P.Gang has adjourned to the 18th of August 2022, on a preliminary objection application brought by the counsel to the commissioner of Police and involving the democratically elected Chairman of Langtang North LGA.
However, after the declaratory judgment obtained by the Chairman of Langtang north Dr Joshua Ubandoma Laven by Justice Ishaku Kunda that there has never been an existing vacancy in the chairmanship of Langtang north before the 2018 Local Government elections in Plateau state.
After not being satisfied with the High Court judgement, the Governor, PLASIEC, Local Government and Chieftaincy Affairs office, and the Attorney General and Commissioner for Justice appealed the judgment entered by the State High Court which the Appeal reaffirmed the decision of the High Court.
Meanwhile, the inter-party affairs Hon Nankar Shagaya of the APC filed a suit challenging the nomination of Barr. Zulfa Rimven that he is not the candidate of APC in the primary conducted so he should benefit from the party goodwill.
As political misplacement of priority, the judgment was appealed but the Appeal reaffirmed the high court judgment rendering the exercise of state government incompetent and undemocratic.
However, the Police Commissioner was asked to enforce the order of not allowing the opposition PDP to enjoy the privileges of APC regime to block Ubandoma Laven coming from to occupy the office of the Executive Chairman of Langtang North
When the matter came up for the continuation of hearing on 10th August 2022 for the defendant/ objector, the Commissioner of police was to enable his counsel to effect service of the counter affidavit on Claimant/ Applicant (Joshua Laven).
Counsel to Commissioner of Police, Barr. Alex (Ms) informed the court that she served her counter affidavit to the Claimant Applicant today 10th August 2022, and needed enough time to study the responses.
The Counsel to the Claimant Applicant barrister Niri Darong confirmed the receipt of the process and urgently called the attention of the court that their pending application of Preliminary Objection is before the court and has been served on the respondent.
He pleaded with the court to allow them to join the two applications together not to be separated during the proceedings with the counter affidavit instead of separate treatment before the substantive matter is entertained.
The Counsel to the defendant objector barrister Alex (Ms) didn’t object to the proposition of the Claimant Applicant, and the judge, Justice S.P Gang adjourned the matter to 18th August 2022, for ruling on the counter affidavit and the Preliminary objection.
