A Plateau State High Court sitting in Jos Division on Monday has ordered the Nigeria Police Command to pay N500,000.00 or risk Jail for failure to enforce Judgement creditor /plaintiff, Dr. Joshua Ubandoma Laven for truncating his tenure of office.
The vacation Judge, Justice S.P. Gang in his Judgment ordered the Plateau State Commissioner of police command to pay as compensation for sealing the office of Executive Chairman, Hon. Dr Joshua Ubandoma Laven will serve as a deterrent for he was saddled with the duty to enforce the rules of law.
“It would be recalled that sometime in June 2022, Dr. Joshua Ubandoma Laven approached the court seeking for interpretation of Judgement obtained as the elected chairman of Langtang North LGA and when tenure hadn’t finished until 10/10/2022,”.
Dr Joshua Ubandoma Laven filed a suit through Counsel, Barr.Niri Darong challenged his illegal removal as while conducting an election for the chairman of Lantang North without the due process of the law.
However, with the Judgment entered in his favour and the Commissioner of Police, CP Bartholomew Onyeka ordered that the office remain under lock and key for insecurity.
It was gathered that based on the Judgement, Barr.Zulfa Rimven was brought to occupy the office to run the council’s affairs without him being elected.
Justice Gang said that by the constitution of the federal republic of Nigeria the Commissioner of police acted extra vire contrary in breaching the law of enforcement handed to him by our laws.
The Executive Chairman of Langtang North Local Government Council of Plateau State, Hon. Joshua Ubandoma Laven has secured the court order to complete the remaining tenure.
The judge ordered that the Claimant,/creditor be allowed into the office any moment from now or any attempt to refuse the order risks.
