Alleged certificate forgery court fixed 6th July for judgment

The Federal High Court sitting in Jos over alleged certificate forgery involving the former deputy Speaker ,Hon Ibrahim Baba Hassan has been adjourned to 6th July,2016 for judgment.

A suit filed by Hon Abdul Sale challenging Hon Ibrahim Baba Hassan ,All Progressives Congress (APC) and Independent National Electoral Commission (INEC) commenced hearing on  preliminary objections and substantive originating surmount on Monday.

Honourable Justice,Musa Haruna Kurya while adjourning the case to 6th July promised to be fair to all the counsels in his judgment.

Counsel to the Plaintiff ,Hon Abdul Sale prayed that the court should dismissed the application brought by the first defendant which is supported by counter affidavit of 16 paragraph with documents attached exhibit A1,A7 B1 ,B3 .

According to him, the documents dated 7th December,2015 ,with  another counter affidavit with 5 paragraph filed on the 18th April documents F1,F4 also adopt the supporting as  reply address.

The plaintiff reiterated that the honourabe court should consider two of its  prayers which is before her ,the issue of substantive originating surmount and preliminary Objections.

Arguing of the originating surmount ,Senior Advocate of Nigeria (SAN) ,Solomon Umoh challenged the plaintiff to come up with facts and prove  beyond reasonable doubt that the certificate presented to INEC was forged .

The SAN argued that no one can challenge the forgery of certificate except the university of Jos which is the custodian can satisfy that the  result belong to the first defendant or not.

Umoh said having application dated 23 April,2016  filed 24th ,2016 seeking your lordship indulgence to  file and  reply in a point of law to the plaintiff response on preliminary objections to ease the will of this proceedings and ready to move.

He said a letter written by the Nigeria Police has confirmed that the accused person is vindicated of alleged hostility and intimidation.

According to him, the plaintiff claims that the registrar of University of Jos ,Bar.  Jili Ndandam refused having knowledge of  the signature on certificate is not true .

Miss F N. Ibrahim  ,the. Independent National Electoral Commission urged the court to dismiss the application for lack of merit and waste of time by the plaintiff.

He urged the court to dismiss the case and let find peace and the interest of justice.

Adding the plaintiff point of argument has nothing to do with the 2nd and  3rd defendants  having conducted peaceful elections so we are seeking your lordship to dismiss its.

The second counsel to APC ,N N Fyaktu also presented fresh application of 7 paragraph affidavit aligning with the written addresses asking the court to use her discretion to exercise on the matter before its.
