Nyako Decries Open Partisanship of Adamawa State Acting Chief Judge
Former Adamawa State Governor Murtala Nyako has decried the open partisanship of Adamawa State Acting Chief Judge; the former Governor said this through a statement signed by his media aide, Ahmad I Sajoh.
“According to the statement, Nyako said; “The acting chief judge of Adamawa justice Ambrose Mamadi has again displayed extreme partisanship in the manner he is handling a case involving his Excellency Vice -Admiral Murtala Hammayero Nyako, GCON. This is particularly so in the case filed on the 8th of August, 2014 by the Counsel to Murtala Nyako, Chief Adeniyi Akintola, SAN.”
“In the suit No ADSY/107/2014 against the Adamawa State Judicial Panel of Enquiry, the learned Counsel accompanied it with an affidavit of urgency stating that unless the suit is expeditiously assigned and given accelerated hearing, the panel will undertake what in our opinion constitute an illegal act and injustice against Admiral Murtala Nyako,” he said.
“According to the writ of summons the relief sought is anchored on contravention of sections 128 and 129 of the constitution of the federal republic of Nigeria 1999 as Amended and other extant laws of the Federation. Whereas the panel had four weeks to conclude its assignment, which commenced in August 2014, the acting Chief Judge assigned the case to Justice Ishaya Banu who is on vacation till the 15th of September, 2014. The purpose is to ensure that by the time the Judge resumes from his vacation, the Panel would have concluded its assignment. Consequently Chief Adeniyi Akintola, SAN had written a Letter to Justice Ambrose Mamadi dated 13th August, 2014 requesting the Acting Chief Judge to assign the case to the vacation Judge Justice Hapsatu Abdulrahman.
“We believe that the essence of a vacation Judge is to ensure that ordinary citizens are not denied justice just become the judges are on leave. It is sheer partisanship on the part of the Acting Chief Judge and a travesty of justice to assign such an urgent and time bound matter that infringes on a citizens fundamental right to a judge on leave when there is a vacation judge on ground.”
