Justice Nnamdi Dimgba of the Federal High Court sitting in Maitama, Abuja has sent back the case file of the immediate past governor of Niger State, Babangida Aliyu, to the Chief Judge, CJ, for reassignment to Minna Division.
The Judge while sending back the case to the CJ ruled that, “in view of the non-opposition of the application by the prosecution, I am therefore sending the case file to the Acting Chief Judge for reassignment of the case to Minna Division which by agreement of parties is proper forum of the trial of the charges”.
Transfer of the case followed an application made by the second defendant Umar Nasko through his counsel, Mammam Osuman, SAN, dated September 28, 2017 and filed same day. The application is seeking the transfer of the case to Minna Division, while challenging jurisdiction of the court.
