Kidney Harvesters: Court Orders Counsel To Present The Death Certificate Of Dr Noah Kekere In Court

Following the alleged removal of the right kidney of Mrs. Kehinde Kamaru Bausari during her appendix operation at Murna Clinic and maternity located in Yanshanu Community of Jos North Local Government Area of  Plateau State , victim’s family filed a suit demanding justice and compensation.

The court ordered that the counsel to the 1st defendant, Barr. E.A Achoba to present the death certificate of Dr Noah Kekere before taking decisive measures, whether to continue or discontinue with his name in the lists of the defendants.

However, when the matter came up for case management, between Kehinde Kamaru and the suspected organ harvesters, and Yusuf Abdullahi, including Murna Clinic Maternity Ltd and Attorney General and Commissioner of Justice, Plateau State.

Chief Bankole Falade, the Senior Advocate of Nigeria, SAN, told journalists that they were in court for compensation for his client who had suffered multiple wounds and injuries as a result of a kidney operation.

According to him, they have a pending motion before counsel to the 1st and 4th defendants raised an issue that he is not ready to proceed with the matter because his client has died.

The second issue is that they were not officially served by the claimant counsel, which includes the 5th and 6th defendants, who also brought a fresh application seeking an extension of time.

Achoba urged the court to strike out the name of his client, Dr. Phillip Dachung, who is now dead, stressing that there is a need to allow his name as defendant, objecting to the application of the claimant’s counsel.

However, Bankole Falade, SAN, urged the court to adjourn to the 31st to enable the defense counsel to present a certificate of death of Dr Noah Kekere. He added that now, we cannot file another motion if the dead certificate of the 1st defendant is not produced.

The court has adjourned the case to 31st March, 2026, for case management and to allow the claimant’s counsel to further file his amended motion of claims.

Speaking to journalists after the session, Chief Bankole explains that they approached the court for compensation and claimed damage inflicted on his client.

He said, we are not part of the first suit, but what happened in court today was on our case management, and the matter couldn’t go on due to a lack of service by the bailiff.
