Kerang Ruling Houses Files Suit Restraining Installation /Coronation Of District Head Of Kerang In Plateau

The Kerang Traditional Ruling Houses has filed a writ of summoned challenging Da Philemon Mutang, HRH Da Nelson Andak Bakfur ,Mangu Traditional council ,Attorney General of Plateau State ,and the Local Government Council of Plateau state over chieftaincy title of the ruling house of Kohopang.

 

The Plaintiff Mr. Ezra Chirang in a suit No.PLD/J20 CV/2014 said the selection of the 1st defendant as the district head of “MISHKAHAM” of Kerang is null ,void and of no effect whatsoever same having not been done in compliance with the native law and custom relating to the selection of the district head mishkaham of Kenang.

 

In his suit dated 15th April, 2015 filed same day, Chirang said there was an order of injunction restraining the 1st defendant from presenting himself for installation /coronation as the district head of Mishkaham of Kerang .

 

Also an order of injunction restraining the 1st defendant from parading himself as the district head of Kerang or by whatsoever other name in relation to the district head of Kerang, he added.

 

Mr Ezra Chirang said for himself and the ruling house of Kohopang, an order of injunction restraining the 2nd ,and 3rd defendants from recognizing the 1st defendant as the district head Head Mishkaham of Kerang respectively.

 

According to him ,an order of injunction restraining the 2nd and 3rd defendant from installing /coronation the 1st defendant as the district head Mishkaham of Kerang .

 

The writ was issued by Barr. E .O  Akhayere ESQ ,of NO 16 ,New Zaria Terrace ,off Tafawa Balewa street ,Jos ha said the case adjourned to 8 of March, 2018 for the continuation of hearing .

 

In the High Court of Justice of Plateau Holden at Jos ,Mr Ezra Chirang disclosed that he warned the 1at defendant ,Da Philemon Mutang ,2nd respond am ,HRH ,Da Nelson Andak Bakfur 3rd Mangu Traditional Council ,4th defendant Attorney General of Plateau state and 5th Local Government Council inclusive .

 

The plaintiff is a Farmer resident in Kerang in Mangu Local Government Area of Plateau state within the jurisdiction of this honourable court .

 

The 1st defendant is a Farmer resident in Kerang in Mangu local government area of Plateau state within the jurisdiction of this honourable court .

 

The 2nd defendant is the Mishkaham Mwaghavul and president of Mangu traditional council and resides in Kerang in Mangu local government area of Plateau state within the jurisdiction of this honourable court

 

The ,3rd defendant is the Mishkaham of mwaghavul development association ,Kerang branch and resides in panyam in Kerang also known as Mishkaham Kerang ,all the adult male of the family of Kohopang relating to the selection of the district head of Kerang also known as Mishkaham Kerang all the adult male of the family of Kohopang including himself is eligible to be selected as the district head Mishkaham of Kerang.

 

The plaintiff avers that the 2nd defendant was the immediate past district head Mishkaham of Kerang before he was elevated to Mishkaham mwaghavul and chairman of Mangu traditional council.

 

The plaintiff avers that in Kerang there are three ruling houses namely; Kohopang, Kohogwen and Pulukum from which the district head of Kerang is selected.

 

The plaintiff avers that by the native law and custom relating to the selection of the district head Mishkaham of Kerang the district head is usually selected by chief priest Sarki Tsafi from any of the three ruling houses who then presents the person so selected to the people for installation.

 

The plaintiff avers that the 2nd defendant who was the district head Kerang prior to his elevation to the position of the Mishkaham of mwaghavul and chairman of the chairman of the Mangu traditional council.
