Impeached Qua’an Pan Chairman Court Case: Court Grants Order To 4th -25th Defendants To Hire Private Counsel

Justice Nafisatu  Mohammed on Friday has granted the 4th and 25th defendants in a suit filed by the impeached Chairman of Qua’an Pan LGA, Hon Isaac Kwallu challenged the Rt Hon Speaker, Plateau State House of Assembly, the office Attorney General of state, and Qua’an Pan  LGA, Ag Chairman, Legislative arm including Councillors.

 

Justice Mohammed ruled that the prayers of defendants to hire private counsel to represent them with the application of 10 paragraph affidavit deposed by Mr. Solomon Kagame signed by the secretary of Qua’an Pan LGA.

 

Mrs. Rebecca Shaseet, deputy director of criminal litigation, Plateau state ministry of Justice as counsel to 1st and 30th defendants announced her withdrawal by selected defendants.

 

However, The senior advocate of Nigeria, Solomon Umoh, SAN, objected to the application seeking by the defendants to represent a private legal practitioner to take over the case that the process of bringing in a private legal counsel was not dully followed in accordance with the practice guideline.

 

Mrs. Rebecca Shaseet placed reliance on all the processes filed by adopting it, she told the court that the 4th to 25th defendants have the right to make a choice of who to represent them in court which base on the practice direction of this honorable court.

 

Justice Mohammed disclosed that I hereby granted the defendants relief sought to allow them to bring in a private legal practitioner to take over their defense.

 

The plaintiff counsel, Solomon Umoh, SAN, proceeded with his amended charge dated 4th September 2020 trial which he reminded the court that a mandatory injunction was filed on the 14th August 2020 where no response was file by the defendant’s counsel to the originating surmount.

 

According to learned silk, this case is sensitive and time bounce this is to be acknowledged if the defendant’s earlier exparte application order is still enforced.

 

Justice Mohammed ruled that the notice of withdrawal by the ministry of Justice has indicated that appearance for 1st to 30th selected defendants that new development both 4th to 25th have been brief by counsels.

 

When the defendants 4th to 25th presented, S.S.Obende to take over but was vehemently objected by Solomon Umoh, SAN, saying is not in accordance with the practice direction of this honorable court stipulated.

 

A Plateau State High Court presided over by Justice Mohammed the case of an embattled sacked Chairman, Hon Isaac Kwallu adjourned to 16th October 2020 for hearing and to file all processes also to serve all counsels.

 

The secretary of Qua’an Pan LGA has written to the Ministry of Justice for the Acting Chairman, Legislative arm and Councilors hire a private legal practitioner to take over which contain five grounds 10 paragraph affidavit with a written address attached
