Federal Govt Strike Out Two Charges Of Case Against Sen. Goje, Alh Dokoro Gombe

The Attorney General of the Federal Government of Nigeria and the ,Attorney General of Gombe State  on Thursday have   withdrawn the two charges label against the Former Governor of Gombe State ,Sen. Danjuma Goje and Alh  S.M Dokoro over the auctioned of vehicles belonging to the state government .

 

Justice Babatude Quadri of the Federal High Court of Jos Division ,Plateau while issuing his judgment  on the application brought by the ,Senior Staff,  the office of attorney General of the federal government said under the 1999 constitution of Nigeria section 108 subsection 2A,3 A of the administration of criminal justice act of 2015 the application hereby granted .

 

He said in view of the charges brought considering that there are 21 charges which was drop to two ,we hereby found you ,Sen. Danjuma Goje and Alh S M.Dokoro not guilty of committing the offenses  and you are now discharge ,the suit  stroke out all charges against you the former Governor of Gombe state ,Sen. Danjuma Goje and Alh S.M Dokoro have been dismissed for lack of concrete evidence prove on you.

 

Justice Quadri commended the members of bar, the General public media for taken their precious time to follow the tribunal right from the beginning to the end.

 

We have a humble application newly taken over this case in view of 21 count charge ,we look at submission and the ruling on spot were out of the 21 the court had already quashed 19 of the charges living only two count in which the defendants called to enter defense. .

 

The office of attorney general currently has more to reply so ,we  hereby withdraw the recent charges , the withdrawal is necessarily under section 148 of the administration of criminal justice act 2015 ,particularly section 1 of that act.

 

My Lord, in accordance to the rule the attorney general and Commissioner for Justice, have the authority to withdraw all charges before this honourable court that is our humble application, we are most up large.

 

However ,Counsel to the two defendants ,(Sen Danjuma Goje and Alh S. M Dokoro ) SAN ,Adeniyi Akintola ,while responding the application told the court that ,My Lord we are not opposing to this application from the prosecution ,script position invoking section 108 subsection 2A,B.of the administration of criminal justice.

 

He urged the court not to only discharge but to also acquitted them which withdrawal was made after making to section 108 (3) give your Lordship power in any trial of offense in the count order acquitted subsection 2B ,3 under not only be discharge but acquitted them.

 

Akintola commended Judge for exhibiting patient to bringing an end to case that started 2011 and he also commended the office of attorney general and commissioner for Justice today.

 

It would be recalled that EFCC arraigned Sen.Danjuma Goje ,3 orders  over alleged  N6.5 billion frauds “.
