The Young Nigerian Rights (YNR) condemns the deliberate refusal of the Delta State Commissioner for Lands and Survey to verify and sign property documents needed for the release of Fejiro Oliver, despite two separate courts granting him bail.
In a statement signed by Comrade Victor Ojei he said; “This action is a clear violation of Section 287(3) of the 1999 Constitution, which compels all authorities to obey court orders.
“It also offends established precedents such as Fawehinmi v. IGP (2002) 7 NWLR (Pt.767) 606 and Governor of Ekiti State v. Ojo (2006) 17 NWLR (Pt.1007) 95, which empower the courts to issue an Order of Mandamus to compel any public officer refusing to perform a statutory duty.”
YNRO demands that Governor Sheriff Oborevwori direct the Commissioner to perform his lawful duty without delay. Should this defiance continue, Fejiro Oliver’s legal team will be supported in filing for a Writ of Mandamus to compel compliance and uphold the rule of law.
