Court  To Auction Ex-Plateau PDP Guber Aspirant, Engr Jimmy Cheto’s  House At No 19,Nasarawa Road Jos Over Unpaid Debt

In a suit No /PLD/J299/2018 between Mallam Hudu Musa, creditor /Applicant, against Engr Jimmy Cheto the Debtor/defendant which charges were based on lack of trust, misappropriation money borrowed money to him for his 2018 campaign and has refused to pay back.

 

Mallam Hudu Musa a businessman who is resident in Jos North LGA of Plateau state said, he approached the court over his money he lent to Engr. Jimmy Cheto through one Andrew Ashom a close associate who approached him to please help Engr. Jimmy Cheto with funds for his electioneering campaign against the 2019 governorship election race.

 

 

The Plaintiff counsel, Barr D.K. Miner told journalists that the case is an undefined list dated 9th July 2018.

 

He said on behalf of his client, he has written two letters to Engr Jimmy Cheto appealing to him to pay the debt of one million given him by his client but Engr Jimmy Cheto has turned a deaf ear to their plea.

 

Miner added that since the matter came up for hearing the case has suffered a series of adjournment because they can’t effect proper service on the defendant.

 

According to the plaintiff counsel, Barr D.K.Miner after obtaining an order for substituted service, the bailiff went to, Engr Jimmy Cheto House to pace the notice of service, he then, discover that the defendant was present at home and the bailiff personally effected service on him.

 

As his client, a businessman, Mallam Hudu Musa obtained a judgment against the Former Director of Federal Capital Development Authority, FCDA, who is an Aspirant For People Democratic Party, PDP, , Engr Jimmy Cheto on the 10-10-2020 secretly obtain an injunction restraining the plaintiff from affecting judgment.

 

Justice N.L.Musa in a judge ordered that the plaintiff on the 26th November 2018 effect the judgment.

 

At this point the plaintiff has made several attempts of trying to execute the judgment but on their entire attempt, the officers of the court would be denied access into the defendant compound.

 

However, Barr Miner said that unknown to the plaintiff that the defendant had already filed a motion for stay of execution defending and dumped  inside the  file in court without them receiving  serving,” the plaintiff said.”

 

On Thursday at about 1:30 pm the court granted an order to the plaintiff against that of stay of execution and was given a marching order to auction the defendant’s house for enforcement.

 

The plaintiff counsel Barr Miner disclosed that when the matter came up on 10th August 2020 for hearing neither the defendant nor his lawyer was present in court.

 

Upon the plaintiff’s application, the defendant’s stay of execution in court was stuck out and the court attached his house No 19, Nasarawa road Jos to satisfy the plaintiff’s judgment of the debt penalty.
