Court grants relief to Village heads to sue Gov. Abubakar and 4 others

Bauchi High Court has  granted relief to Four Traditional title holders in Bauchi State to file a judicial review to prohibit Gov Mohammed Abubakar and four others from assenting a bill on repeal of creation of districts.

The Presiding Judge Justice Sa’ad Zadawa, gave the relief yesterday while ruling on motion exparte filed before it by Musa Khalid, Muhammed Adamu, Salihu  Muhammed and Abubakar Mator district heads of Danjin, Jabire, Gimzum and Jaban.

Zadawa, however, refused to grant the request by the applicants to restrain the governor and four others from assenting the bill for a law to repeal a law to create districts, village areas and hamlets.

He further refused to grant their requests to direct the speaker, Bauchi State House of Assembly to transmit the certified copy of the bill for a law to repeal a law to create districts, village areas and hamlets.

Zadawa also refused to grant an order to restrain the governor, Bauchi Assembly, speaker Bauchi Assembly, Local Government Service Commission and the Attorney-General of the state from taking any action on the matter pending the determination of the motion on notice.

He, then directed the applicants to put the respondents on notice and adjourned the case to September 6, 2016 for hearing of motion on notice pending before the court.

The applicants, appointed by former gov Isa Yuguda had gone to court to challenge the nullification of their appointments following a bill passed by the state assembly.

They prayed the court to restrain the respondents from assenting the bill which if assented would jeopardize the motion on notice challenging the bill passed by the assembly.‎
