Breaking: Court Nullifies Adamawa APC Governorship Primary

The Federal High Court sitting in Yola, Adamawa state has nullified the APC gubernatorial primaries that produced Sen Aishatu Dahiru Ahmed, a.k.a Binani as the gubernatorial candidate.

The presiding judge, Justice Abdul-aziz Anka declared as null and void the election conducted on May 26, 2022 by the APC and accordingly annulled the purported victory of Binani as the winner of the election.

The court said APC could not go into the 2023 gubernatorial election and cautioned Sen. Aishatu Dahiru Ahmed Binani from parading herself as the gubernatorial candidate of the party.

Declaring the judgment Friday, Justice A.M Anka said he passed the judgment based on substantial noncompliance with party guidelines and the constitution of the federal republic of Nigeria.

Justice Anka held that 51 (1 to 4) of the Electoral Act was violated seeing there was ‘overvoting’ during the May 27, 2022 declaration of the results of the APC governorship primary election in Adamawa state.

He held that 50 delegates from Lamurde Local Government Area who ought not to have voted during the primary election were allowed to vote. He held that there was no evidence that the party had conducted a Special Adhoc Delegates election there.

“It is in the interest of our nation that political parties should adhere to internal democracy rules,” Justice Anka quoted a Supreme Court decision.

Ribadu had dragged APC Governorship Candidate, Aishatu Binani, APC and INEC before the court, seeking the nullification of the primary election conducted on the 27th May, 2022, where he prayed for the disqualification of Binani or the conduct of fresh party primaries over alleged vote buying, over voting and impasse over Lamurde local government delegates.

In his motion on notice, Ribadu is not only seeking for the nullification of the primary election conducted on the 27th May, 2022, but the disqualification of Binani, who was declared winner of the exercise.
